Payment Terms
Unless otherwise specified by Photographic Commerce LLC, all online customers must pay in full with placement of order using Visa, MasterCard, American Express, Discover Card, or Pay Pal via our online system. Invoices will be issued when the order is made and processed. Customer requests to cancel or modify an order for which processing has commenced shall be honored to the extent possible. Claims for adjustments must be presented to Photographic Commerce LLC in writing within (10) ten days from the date of invoice. Customer agrees to pay all attorney fees, collection fees, court costs and other expenses incurred by Photographic Commerce LLC to enforce its rights under this agreement.

Returns - Damaged Shipments
It is important to inspect your shipment when it arrives and note discrepancies on the freight bill at the time of delivery. WE CANNOT PROCESS CLAIMS FOR SHIPMENTS SIGNED AS COMPLETE AND UNDAMAGED and later found to be incomplete or damaged. Look for dents, punctures, flattened corners and short counts. Make sure the tamper-proof tape sealing the package is intact. If not, check the package for damage or theft before the carrier leaves. If you sign for your shipment and then find concealed damage, such as torn product packaging or broken products, call the delivering carrier for a damage inspection, then notify us. Retain all shipping materials for inspection.
Software
To return software product(s) due to a damaged shipment, you must report claims at  , within five (5) days of receiving your shipment. You will be given a Return Authorization Number, which will be valid for five (5) days after being issued. Any software product(s) being returned must be unopened in its original product packaging, and must be securely repackaged in a shipping carton for the return, along with a copy of the invoice or packing receipt. Clearly write the Return Authorization Number on the outside of the shipping carton. Software product(s) must be returned via UPS or US mail, prepaid and insured. Customer is responsible for all shipping charges for any returned software product(s).
If the seal(s) on the software product packaging has been broken or other conditions contained herein are not met, your software product(s) will not be accepted for return. If returned software product(s) meet the conditions contained herein, we will exchange the product(s) for the same product(s). Software returns due to damaged shipments are not eligible for refunds.
Portfolios & Cases
To return House of Portfolio product(s) due to a damaged shipment, you must report claims at , immediately after receiving your shipment. You will be given instructions on where to return the product(s). Product(s) must be securely repackaged in a shipping carton for the return, along with a copy of the invoice or packing receipt. Product(s) must be returned via UPS or US mail, prepaid and insured. Customer is responsible for all shipping charges for any returned product(s). To receive credit for non-personalized stock item defects, the item(s) must be returned within five (5) business days upon receipt.
Returns – Defective Products
Software
If a software product is found defective within ninety (90) days from the date of receipt, Photographic Commerce LLC will (a) return the amount paid (if any) for the software, or (b) repair or replace the software. You will receive the remedy elected by Photographic Commerce LLC without charge, except that you are responsible for any expenses you may incur (e.g. cost of shipping the software). This Limited Warranty is void if failure of the software has resulted from accident, abuse, misapplication, abnormal use or a virus. Any replacement software will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. Contact Photographic Commerce LLC at , to exercise your remedy.

Portfolios & Cases
The House of Portfolios guarantees all its products against manufacturing defects. It is important that you inspect your shipment carefully upon receipt. Any custom-made manufacturing defect is returnable pending immediate notification at , option 2. You will be given instructions on where to return the product(s). To receive credit for non-personalized stock item defects, the item(s) must be returned within five (5) business days after receipt. Product(s) must be sent back via UPS or US mail, prepaid and insured. Customer is responsible for all shipping charges for any returned product(s). All returnable articles must be received in acceptable condition.
Warranty Disclaimer
Software
Photographic Commerce LLC warrants that its software product(s) will perform substantially for a period of ninety (90) days from the date of receipt. If an implied warranty or condition is created by your state /jurisdiction and federal or state/provincial law prohibits disclaimer of it, you also have an implied warranty or condition, BUT ONLY AS TO DEFECTS DISCOVERED DURING THE PERIOD OF THIS LIMITED WARRANTY (NINETY DAYS). AS TO ANY DEFECTS DISCOVERED AFTER THE NINETY-DAY PERIOD, THERE IS NO WARRANTY OR CONDITION OF ANY KIND.
Except for the Limited Warranty and to the maximum extent permitted by applicable law, Photographic and its suppliers provide the Software and support services (if any) AS IS AND WITH ALL FAULTS, and hereby disclaim all other warranties and conditions, whether express, implied or statutory, including, but not limited to, any (if any) implied warranties, duties or conditions of merchantability, of fitness for a particular purpose, of reliability or availability, of accuracy or completeness of responses, of results, of workmanlike effort, of lack of viruses, and of lack of negligence, all with regard to the Software, and the provision of or failure to provide support or other services, information, software, and related content through the Software or otherwise arising out of the use of the Software. ALSO, THERE IS NO WARRANTY OR CONDITION OF TITLE, QUIET ENJOYMENT, QUIET POSSESSION, CORRESPONDENCE TO DESCRIPTION OR NON-INFRINGEMENT WITH REGARD TO THE SOFTWARE.
Portfolios & Cases
Photographic Commerce LLC expressly disclaims all warranties either expressed or implied, including any implied warranty of merchantability or of fitness for a particular purpose. Photographic Commerce LLC shall have no liability to anyone for incidental or consequential damages or any other liability, loss or damage arising out of or related to House of Portfolio merchandise. This disclaimer by Photographic Commerce LLC in no way effects the terms of a House of Portfolio warranty if applicable.
Limitations on Use

Photographic Commerce LLC makes no representation or warranties with respect to the information, data, or contacts (“Contacts”) included in the software and/or downloaded from Photographic Commerce LLC’s website and specifically disclaims any implied warranty as to the accuracy, completeness, and/or suitability, of the Contacts and of Photographic Commerce LLC’s ability to continue providing updated Contacts. Photographic Commerce LLC makes no representation or warranty as to the existence of any jobs or the ability of any Contacts to offer jobs. Photographic Commerce LLC is not involved with, associated with, or an agent for any Contacts. If you have a dispute with one or more Contacts, you agree, by using this Software, to release and indemnify Photographic Commerce LLC (including its employees, officers, and agents) from all claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of, or in any way connected with such disputes.
The Contacts included in the Software and/or downloaded from Photographic’s website may contain email addresses (“Email Addresses”) and are provided for informational purposes, and may be used for transactional or relationship messages only, and may not be used for advertising, or promoting a commercial product or service, or for spam, or mass emailing. This specifically prohibits the Email Addresses from being used to spam or to otherwise email contacts with unsolicited offers. You warrant and agree not to use the Email Addresses for any such purposes and agree to indemnify Photographic for any liabilities arising from your improper use of the Contacts, including but not limited to, the Email Addresses.
